4. Engaging Our Services

4.1 Initial Enquiry

Submitting a contact form enquiry or calling our office does not create a legal advisory relationship. An engagement begins only when both parties have agreed in writing to the scope, fee, and terms of the specific service to be provided.

4.2 Fees and Payment

Fees for each service are stated on our website and will be confirmed in writing before work begins. Fees are fixed and inclusive of all work within the stated service scope. Any work falling outside the agreed scope requires a separate written agreement. All fees are stated in Thai Baht (THB) and are payable as set out in the written engagement agreement.

4.3 Scope of Legal Services

Our services are limited to the specific pension legal matters described on this website and in the written engagement agreement. We do not provide general legal advice, tax advice, financial planning advice, or advice on matters outside the scope of our stated services. Where a matter requires expertise outside our scope, we will advise you accordingly.

4.4 Client Responsibilities

To enable us to carry out our work, you agree to provide accurate and complete information, supply documents requested in a timely manner, inform us promptly of any changes to your circumstances that may affect the matter, and respond to our written communications within a reasonable period.

5. Confidentiality

All information shared with us in connection with an engagement is treated as strictly confidential and subject to legal professional privilege where applicable. We will not disclose client information to third parties except where required by law, by court order, or where specifically instructed by you in writing (for example, to share information with an estate administrator or pension authority in the course of your matter).

Our liability in connection with services provided under these terms is limited to direct losses caused by our negligence or breach of the engagement agreement. We are not liable for indirect or consequential losses, including loss of pension entitlement arising from decisions made independently by you, decisions made by the relevant pension authority, or delays within the pension authority's own review process.

Nothing in these terms limits our liability for fraud, fraudulent misrepresentation, or any liability that cannot be limited by law.

8. Termination of Engagement

Either party may terminate an engagement by giving written notice. Where you terminate an engagement that is in progress, you will be liable for fees in respect of work already completed or committed at the date of termination, as set out in the engagement agreement. Where we terminate an engagement, we will provide written notice and a summary of the work completed to that point.

9. Complaints

If you are dissatisfied with any aspect of our service, please write to us at [email protected]. We will acknowledge your complaint within five working days and aim to respond substantively within twenty working days. If a complaint cannot be resolved directly, you may seek recourse through the Lawyers Council of Thailand.

10. Governing Law

These terms are governed by the laws of Thailand. Any disputes arising in connection with these terms or with services provided by sukhothinz shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.

11. Changes to These Terms

We may update these Terms and Conditions from time to time. The updated date at the top of this document indicates when the current version was last revised. For ongoing engagements, changes to terms will be communicated in writing and will not apply retroactively without your agreement.
